Separation & Divorce

Family Law experts, Roberts Family Law provides practical and strategic advice to both married and de facto clients. Defacto couples who have lived together for more than 2 years are treated in the same way as married couples in property matters.

For married clients we can assist in filing your divorce application in the Federal Circuit and Family Court, ensuring that you obtain your divorce as efficiently and quickly as possible.

To obtain a divorce you need to show that you and your partner have been separated for a continuous period of more than 12 months (or 1 year) and there is no reasonable likelihood of reconciliation.

Parties may be separated but continue living under the same roof. If this truly reflects your circumstances then you may file a divorce application. You will need to also file with your application appropriate evidence setting out details of your arrangements whilst you were living under the same roof.
